DS4Prada Terms of Sale, Use, and Liability Disclaimer

Overview: This document constitutes the official policy for DS4Prada, an e-commerce platform specializing in the sale of digital controller profiles optimized for use with Call of Duty and other games. These profiles include customized dead zones and output curve values for controllers, designed to enhance gameplay experience for users. By purchasing any product from DS4Prada, you agree to the terms and conditions outlined below.

 

 

1. Product Description

DS4Prada offers digital downloads of optimized controller profiles designed for use with controllers such as the DualShock 4 & DualSense 5.

These profiles are intended to:

  • Provide optimized dead zone and output curve settings.

  • Enable use of controllers on PCs with games that do not natively support controllers, through third-party software like DS4Windows.

  • Enhance user customization for gaming experiences.

2. Licensing and Usage

  • Upon purchase, the customer is granted a non-exclusive, non-transferable license to use the digital profile for personal, non-commercial purposes.

  • Redistribution, resale, or modification of the digital profile is strictly prohibited.

  • The profiles are compatible with the DS4Windows tool, which allows remapping of keys from keyboard and mouse to supported controllers. Customers are responsible for downloading and correctly configuring DS4Windows if necessary.

3. Payment and Delivery

  • All sales are final. DS4Prada does not offer refunds or exchanges for digital products once a purchase has been completed.

  • Upon payment confirmation, the purchased profile will be delivered via a downloadable link sent to the customer’s registered email.

4. Customer Responsibilities

By purchasing and using DS4Prada’s products, the customer acknowledges and agrees to the following responsibilities:

  • Software Compatibility: Customers are responsible for ensuring their device supports the use of the DS4Windows tool or similar software. DS4Prada does not provide technical support for third-party software.

  • Hardware Compatibility: Customers are responsible for ensuring their controllers and gaming systems are compatible with the purchased profiles.

  • Game-Specific Configuration: Certain games may require additional settings adjustments. DS4Prada is not liable for any issues arising from game-specific configurations.

5. Limitation of Liability

Once the product is delivered, DS4Prada relinquishes all responsibility for:

  • Improper use or misconfiguration of the digital profile.

  • Damage to hardware, software, or gameplay experience arising from the use of our products.

  • Incompatibility issues with specific games, controllers, or third-party software.

  • Unauthorized modifications made to the digital profile by the customer.

6. Legal Considerations

6.1. Compliance with Third-Party Terms:

  • DS4Prada is not affiliated with Sony, Nintendo, or any third-party gaming software companies. Customers are responsible for ensuring compliance with the terms of service of these third-party entities.

6.2. Third-Party Software Use:

  • The DS4Windows tool is an open-source third-party software. DS4Prada does not endorse or guarantee the legality or safety of its use. Customers use DS4Windows at their own risk and discretion.

6.3. No Warranty:

  • DS4Prada provides digital products “AS IS” with no warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

The customer agrees to indemnify and hold DS4Prada harmless from any claims, damages, or losses arising from:

  • Use or misuse of the digital profiles.

  • Violations of third-party terms of service.

  • Legal disputes related to third-party software use.

8. Jurisdiction and Governing Law

This policy and any disputes arising under it shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles. Any legal action related to this policy must be brought in the courts located in [Insert City, State].

9. Amendments and Updates
